# Samkoma — Terms of Service **Last updated:** 2026-09-14 · **Provider:** Lavelle Woodworking Studio LLC d/b/a Samkoma · **Contact:** support@samkoma.co By purchasing a plan or using the Samkoma platform ("**Service**"), you ("**Customer**", "**you**") agree to these Terms. If you are agreeing on behalf of an organization, you represent that you have authority to bind it. ## 1. The Service Samkoma provides hosted event registration, check-in, payments coordination, and related tools for event organizers, delivered per the plan you purchase (Free/Community, Tier A, Tier B, Tier C) plus any add-ons. Features vary by plan and are described on `samkoma.co`. We may improve, change, or discontinue features; material reductions to a paid plan you are actively using will be communicated in advance where practicable. ## 2. Accounts and eligibility You must provide accurate account and event information and keep your credentials secure (including your mandatory second factor). You are responsible for all activity under your account and for your own staff/volunteers you grant access. The Service is for organizers operating in the United States; you are responsible for the lawfulness of your event and your use of the Service. ## 3. Fees, plans, add-ons, and upgrades - **Platform fees** are the plan price shown at checkout, charged to Samkoma's payment processor (Stripe). Applicable **sales tax** is calculated and collected at checkout. - **Add-ons** (e.g. SMS, voting, PDF studio, branding) are purchasable at checkout or later, at the prices shown, per event. - **Tier upgrades** are charged the price difference; where an add-on you already purchased is included in the higher tier, that amount is credited toward the upgrade. - **Free tier** requires a payment method on file but is not charged for the base plan. - **No refunds after your event registration has been opened to the public.** Before you open registration, the platform fee is refundable on request: email support@samkoma.co and we will issue it. Refunds are handled by us manually rather than through a self-serve button. - Fees are exclusive of taxes except as stated. Prices may change prospectively. ## 4. Registrant payments are yours, not ours If your event charges attendees an entry fee, **those attendee payments are processed through your own connected payment processor** (your Stripe account, or another processor where we have made one available to you), and the funds settle to you as the merchant of record for your event. Samkoma is not a party to, and does not hold, your attendees' funds. You are responsible for your own processor agreement, your tax obligations on attendee revenue, and refunds/chargebacks to your attendees. Likewise, if you use SMS, you connect **your own Twilio account** and own the associated A2P messaging registration and compliance. ## 5. Your content and data You retain all rights to the event and attendee data you put into the Service ("**Customer Data**"). You grant Samkoma a limited license to host and process Customer Data solely to provide the Service. You are the controller of attendee personal data; Samkoma processes it as your processor under the **Data Processing Addendum**, which is incorporated by reference and published alongside these Terms. You are responsible for the accuracy of Customer Data and for providing your attendees any notices and obtaining any consents your event requires. ## 6. Acceptable use You will not use the Service to: violate law; upload unlawful, infringing, or malicious content; attempt to breach security, access other tenants' data, or disrupt the Service; send unlawful communications; or resell the Service without authorization. We may suspend accounts that pose a security, legal, or payment risk. ## 7. Data retention Live event data is retained through your event and for a limited window afterward, then purged by us on or after approximately day 35 after the event (subject to the DPA), after which only a minimal event record (name, date, location) is retained for your account history. Export what you need before the purge window closes. See the DPA for specifics. ## 8. Intellectual property Samkoma and its software, trademarks, and site content are owned by the Provider. These Terms grant you a limited, non-exclusive, non-transferable right to use the Service; no other rights are granted. ## 9. Service availability; warranties The Service is provided **"as is" and "as available."** To the maximum extent permitted by law, Samkoma disclaims all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant uninterrupted or error-free operation. ## 10. Limitation of liability To the maximum extent permitted by law, Samkoma will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or revenues. Samkoma's total liability arising out of or relating to the Service will not exceed the fees you paid Samkoma for the event giving rise to the claim. Nothing limits liability that cannot be limited under applicable law. ## 11. Indemnification You will defend and indemnify Samkoma against third-party claims arising from your event, your use of the Service, your Customer Data, or your breach of these Terms, to the extent permitted by law. ## 12. Term and termination These Terms apply while you use the Service. Either party may terminate for material breach not cured within 30 days of notice. On termination, your right to use the Service ends; Customer Data is handled per the DPA's return/deletion provisions. ## 13. Changes to these Terms We may update these Terms; material changes will be posted and, where practicable, notified. Your continued use after changes take effect constitutes acceptance. ## 14. Governing law and disputes These Terms are governed by the laws of the State of North Dakota, without regard to conflict-of-laws rules. The parties submit to the state and federal courts located in North Dakota, unless applicable law requires otherwise. ## 15. Miscellaneous These Terms and the DPA are the entire agreement on their subject matter. If any provision is unenforceable, the rest remains in effect. Failure to enforce is not a waiver. You may not assign these Terms without our consent; we may assign them to a successor. **Questions:** support@samkoma.co
